Custom Order & Measurement Terms

These Custom Order & Measurement Terms ("Custom Terms") apply to standard-size made-to-order products, made-to-measure products and fully custom designs supplied by FocusLatex. They explain how quotations, measurements, design approvals, production, changes, fit concerns and alterations are handled.

These Custom Terms must be read with the relevant product page or quotation, the final written specification, our Terms of Service, Privacy & Cookie Policy, Shipping Policy, Return, Refund & Cancellation Policy, and Latex Care & Safety guide. If a separately negotiated written agreement for a particular order conflicts with these Custom Terms, the specifically agreed term controls for that order.

Only an account holder aged 18 or over may place a custom order, confirm measurements or specifications, or submit custom-order material. A person under 18 must not use another person's account to place or manage an order.

Nothing in these Custom Terms excludes or limits a mandatory consumer right that cannot lawfully be excluded or limited.

Custom Order Categories

FocusLatex may offer the following order categories:

  • Standard-size made-to-order: manufactured after ordering in a standard size and the options shown on the product page;
  • Made-to-measure: patterned or adjusted using the customer's confirmed body measurements and accepted fit requirements; and
  • Fully custom design: developed from an individually reviewed design brief and may include custom panelling, colours, thicknesses, openings, zippers, gloves, socks, hoods, accessories, artwork or other agreed details.

The category stated on the product page, quotation or order acceptance email determines which process applies. A product is not automatically made-to-measure merely because it is manufactured after payment.

Enquiries, Feasibility and Quotations

Before accepting a custom request, FocusLatex may review:

  • the intended design, use and fit;
  • measurements and body proportions relevant to the pattern;
  • latex colour, thickness and availability;
  • panel layout, joins, reinforcement and construction method;
  • zippers, openings, gloves, socks, hoods and accessories;
  • artwork, logos and other customer-supplied content;
  • safety, age, legal and intellectual-property considerations;
  • estimated production time; and
  • the price and any special shipping requirement.

We may ask questions, suggest structural changes, decline technically impracticable features, or refuse a design that is unsafe, unlawful, infringing, involves a minor in prohibited content, or cannot be manufactured to a reasonable standard.

Unless stated otherwise, a quotation is based only on the specifications available when it is issued. A material change to measurements, design, thickness, colour placement, hardware, accessories or required work may require a revised quotation and production estimate. No additional charge will be imposed without the customer's agreement.

Order Acceptance and Production Start

Submitting information or making payment does not by itself mean that a custom order has been accepted. A binding contract is formed as described in the Terms of Service when FocusLatex sends the order acceptance email.

The production period begins only after:

  1. full payment has cleared;
  2. every required measurement has been supplied and checked;
  3. the customer has confirmed the final measurement record in writing;
  4. all design, colour, thickness, panel, zipper, opening and accessory details have been confirmed; and
  5. FocusLatex has confirmed that the order is ready to enter production.

Time spent waiting for information, remeasurement, payment clearance, design approval or another required customer response is not part of the production period.

Accepted Measurement Sources

For made-to-measure orders, measurements may be taken:

  • by the customer following the current FocusLatex measurement guide;
  • by another adult assisting the customer in accordance with that guide; or
  • by a tailor or other competent professional using the FocusLatex measurement points and instructions.

Measurements from an existing garment may be useful as supplementary fit information but are not accepted as a substitute for the required body measurements unless FocusLatex agrees otherwise in writing for the specific order.

FocusLatex does not normally provide an in-person measurement service. A customer who uses a third-party measurer remains responsible for checking that the final submitted figures and measurement points match the FocusLatex guide.

How to Measure

Unless the applicable measurement guide states otherwise:

  • use a flexible, undamaged measuring tape;
  • provide all measurements in centimetres;
  • measure over bare skin or close-fitting thin clothing, not over bulky clothing;
  • stand in the posture and position shown in the guide without deliberately holding the body in or extending it;
  • keep the tape level, smooth and appropriately close to the body without compressing the tissue or leaving avoidable slack;
  • use another person to assist wherever possible;
  • measure every key point at least twice; and
  • recheck any result that differs materially between attempts or appears inconsistent with related measurements.

Do not estimate, copy a generic size chart, convert an uncertain garment size into body measurements, or deliberately reduce a measurement in an attempt to create a tighter garment. Pattern reduction and negative ease are determined during pattern development according to the product, material, structure and confirmed fit preference.

Customer Responsibility for Measurements

The customer must provide complete and accurate information and must review the measurement point, number and unit before confirmation. FocusLatex may identify an obvious inconsistency, but it cannot independently verify the customer's body measurements remotely and is not responsible for detecting every measuring error.

If a measurement appears incomplete, unusual or inconsistent, we may request photographs, clarification or remeasurement. A request to remeasure does not mean that FocusLatex has assumed responsibility for the original figure.

The customer must not confirm a measurement record unless it accurately reflects the measurements they intend us to use. If another person placed the order or took the measurements, the wearer or authorised customer must still review the final record.

Fit Preference and Expected Result

The customer must communicate the intended fit, mobility needs and relevant use before final confirmation. FocusLatex will use the accepted measurements and fit preference to develop or adjust the pattern, but made-to-measure production does not guarantee:

  • an entirely wrinkle-free surface in every posture;
  • identical tension over every part of the body;
  • the same appearance as a digital rendering, model photograph or another customer's garment; or
  • that every subjective preference about tightness, compression or mobility will be achieved without adjustment.

Actual fit is affected by body shape, posture, movement, individual sensitivity, latex thickness, panel placement, openings, zippers, reinforcement and design structure. The finished garment may intentionally measure smaller than the corresponding body measurement because latex garments commonly incorporate pattern reduction or negative ease. A direct comparison between an unstretched garment dimension and a body measurement does not by itself establish an error.

A customer's subjective view that a correctly made garment feels tighter or looser than expected is not automatically a manufacturing defect. However, if FocusLatex fails to follow the measurements, fit instruction or specification it accepted, the matter will be handled as a FocusLatex error under our Return, Refund & Cancellation Policy.

Optional Body and Reference Images

Body photographs are generally voluntary, and FocusLatex does not require nude photographs for measurement or ordinary fit review.

For a complex made-to-measure or fully custom order, we may ask the adult customer to provide front, side and back photographs while wearing close-fitting, non-transparent clothing. The request will be limited to information reasonably useful for reviewing proportion, posture, design placement or fit. If the customer declines an optional image, we will explain whether we can continue using measurements alone or whether a particular design cannot be assessed reliably.

Images and measurement information are handled in accordance with our Privacy & Cookie Policy. Customers must not submit identification documents, images of minors, unlawful material, or an image they do not have the right to provide. Any image containing nudity, sexual content or intimate body areas may be submitted only by a person aged 18 or over and only where FocusLatex has expressly requested or agreed to receive it through an approved channel.

We will not use private measurement or reference images for advertising, social media or a public portfolio without separate, specific permission.

Design Previews and Colour References

A sketch, mock-up, digital rendering, marked reference image, colour sample photograph or screen preview is a communication aid and is not a photograph or exact simulation of the finished product.

The customer must check the final written specification, including:

  • the final measurement record and fit preference;
  • latex colours, thicknesses and panel placement;
  • zippers, openings, gloves, socks, hoods and other accessories;
  • text, artwork, logos, markings and personalised details; and
  • any agreed exclusions, limitations or safety changes.

Screens, lighting, photography and material batches may produce reasonable colour differences. Handmade assembly may produce reasonable variation in seam position, joins, alignment, finish or placement where the overall design, function and structural integrity remain materially consistent with the accepted specification.

Written Approval

Production will not begin until the customer has approved the final required information in writing. Approval may be recorded through the website account, email or another communication channel accepted by FocusLatex.

Silence, failure to reply, payment, or approval of an earlier draft does not constitute approval of a later or materially changed specification. FocusLatex should retain the final approved measurement record and specification with the order file.

The customer should save a copy of the approved information. If the confirmation summary contains an error, the customer must notify us immediately and before production begins.

Changes After Confirmation

A requested change after final confirmation is subject to technical feasibility, material availability and production status.

  • Before pattern or production work begins, we will review the request and advise whether the price or estimate changes.
  • After pattern development, cutting or assembly begins, we do not guarantee that a measurement, design or configuration can be changed.
  • If a change is possible, the customer must approve any additional charge and revised production estimate before the additional work begins.
  • If the requested change cannot be incorporated into the existing product, a new product or remake may be required at the customer's expense, subject to mandatory law and any responsibility of FocusLatex.

A change is not accepted until FocusLatex confirms it in writing. Sending a request does not suspend or amend production unless we confirm that it does.

Body Changes After Confirmation

The customer must promptly tell FocusLatex if their measurements, weight, body shape, mobility needs or other fit-relevant circumstances change after confirmation.

If notice is received before production begins, we will assess whether remeasurement, a revised pattern, additional work, a new quotation or a revised schedule is required. Once production begins, modification is not guaranteed. If the existing item cannot be safely or reasonably altered, a paid remake or new order may be required.

A fit issue caused by a body change after the customer confirmed the measurements is not by itself a manufacturing defect.

Customer Response Delays

If required information or approval remains outstanding:

  • the production period is paused until all required information is confirmed;
  • no response is treated as no approval, not as deemed consent;
  • the original production slot may be lost if the delay affects scheduling or material allocation; and
  • after confirmation resumes, FocusLatex will provide a revised estimate where the previous estimate is no longer reasonably achievable.

We may contact the customer using the details supplied with the order. The customer is responsible for monitoring those channels and notifying us of any change. Any right to cancel an inactive or excessively delayed order remains subject to the Terms of Service, Return, Refund & Cancellation Policy and mandatory law.

Repeat Orders and Stored Measurements

Measurements can change over time. Every repeat order therefore requires the customer to review and confirm the measurements again.

The customer may ask us to use a previous measurement record, but:

  • we will not begin production from that record without new written confirmation;
  • we may require complete or partial remeasurement because of the time elapsed, a reported body change, a different product structure or an apparent inconsistency;
  • previous fit does not guarantee identical fit in a different design, thickness or construction; and
  • the customer remains responsible for confirming that the reused figures are current and correct.

Storage and deletion of measurement records are governed by the Privacy & Cookie Policy. A customer should not assume that an old record remains available indefinitely.

Samples, Fittings and Prototypes

An in-person fitting, physical toile, test garment, prototype or sample is not included unless the written quotation expressly states that it is included. Where a sample or additional fitting stage is separately agreed, the quotation should state its price, materials, approval process, shipping responsibility and effect on the production schedule.

Approval of a sample or fitting stage applies only to the features reasonably demonstrated by that stage. It does not remove the customer's responsibility to check the final specification or FocusLatex's responsibility to supply conforming goods.

Handmade Tolerances

FocusLatex products are individually handmade from elastic natural latex. Reasonable hand-production variation may occur. A reasonable variation that does not materially affect fit, appearance, strength, structure, agreed function or safe use is not by itself a manufacturing defect.

No single numerical tolerance applies to every product, part or measurement unless a specific tolerance is stated on the product page, quotation or final specification. Assessment may take account of:

  • the measurement point and method;
  • whether the item is measured relaxed, flat or under tension;
  • material thickness and elasticity;
  • curves, joins, reinforcement, zippers and hardware;
  • the intended pattern reduction and fit; and
  • whether the variation has a material effect on the accepted specification.

This section does not permit FocusLatex to disregard confirmed measurements or specifications, and it does not remove any mandatory conformity right.

Trying On and Reporting a Fit Concern

On delivery, inspect the product and carry out a careful initial fitting using the correct latex dressing method. Do not use excessive force. If the product cannot be tried on safely, stop and contact us.

A fit or apparent measurement issue should be reported promptly, preferably within 48 hours after receipt where reasonably possible, to help preserve evidence and allow timely assessment. This notification period does not remove a mandatory right that applies for longer.

The customer may be asked to provide:

  • the order number and a clear description of the issue;
  • photographs or video showing the overall fit and affected area;
  • a repeat measurement of the relevant body points using the original method;
  • photographs showing the tape position where reasonably necessary; and
  • the garment for physical inspection where photographs are insufficient.

Only an adult should provide body or wearing images. Nude images are not required. Customers should stop using the item beyond what is reasonably necessary for a careful fitting if continued wear may damage it, contaminate a hygiene-sensitive product or worsen the issue.

Inspection of the Finished Product

Where return inspection is necessary, the customer must obtain written return authorisation and use the address and instructions supplied by FocusLatex. The Hong Kong business address and any payment-partner address are not return addresses unless we expressly confirm otherwise for the specific return.

Inspection may compare the product with the approved specification, pattern intent and relevant construction method. Because latex garments may use negative ease, a relaxed flat garment measurement is not automatically expected to equal the corresponding body measurement.

If inspection confirms that the alleged issue is not a manufacturing or specification error, the item may be returned unchanged or a paid alteration may be offered. The customer is responsible for applicable inspection, alteration, return and reshipping costs to the extent permitted by law and stated in the Return, Refund & Cancellation Policy.

Alterations and Remedies

If a fit problem results from incorrect, incomplete or outdated measurements supplied or reconfirmed by the customer, an uncommunicated fit preference, or a customer body change:

  • FocusLatex may offer a paid alteration where technically feasible;
  • the alteration price will be quoted individually according to the required work;
  • the customer is responsible for the alteration fee and actual return and reshipping costs; and
  • some products cannot be altered safely or without materially changing the design, in which case a paid remake or new order may be required.

If FocusLatex failed to follow the accepted measurements or specification, the matter will be handled as a quality issue. The normal remedy sequence is repair first, remake if repair is not feasible, and refund if the matter still cannot be resolved, subject to applicable mandatory law and the Return, Refund & Cancellation Policy.

After a repair or remake is agreed, FocusLatex will provide an individual estimated timeframe. A remedy does not extend to damage caused by forced dressing, misuse, incompatible chemicals, improper care, unauthorised alteration or third-party work, except to the extent mandatory law provides otherwise.

Cancellation, Withdrawal and Refunds

Where Spanish statutory withdrawal rights apply to an eligible order, the statutory notice and refund periods take priority. For a valid statutory withdrawal, reimbursement is due without undue delay and within 14 calendar days after notification, subject to lawful withholding until the goods or evidence of their return are received. See our Return, Refund & Cancellation Policy for the full procedure and exceptions.

FocusLatex offers a voluntary cancellation period of 24 hours after payment for ready-to-ship, standard-size made-to-order, made-to-measure and fully custom orders. A request must be submitted to support@focuslatex.com and is effective when confirmed in writing.

After that voluntary period, a made-to-measure or fully custom order generally cannot be cancelled merely because the customer changes their mind, especially after measurements, design, materials, colours or configurations have been approved or production has begun.

Where applicable law provides a mandatory withdrawal right, FocusLatex will honour it. A statutory change-of-mind withdrawal right may not apply to goods made to the customer's measurements or individual specifications or to clearly personalised goods, where the legal conditions for the exception are satisfied. This exception does not remove rights relating to goods that are faulty, unsafe, materially not as described or otherwise non-conforming.

Approved refunds are submitted to the original payment method within 25 business days after approval, or earlier where applicable law requires. The customer's bank or payment provider may require additional processing time.

Customer Artwork and Design Rights

The customer must have the legal right to use all submitted artwork, photographs, logos, characters, trademarks and designs. FocusLatex may request evidence of permission and may refuse unlawful, infringing, unsafe or technically impracticable content.

The customer owns the finished physical product after purchase, subject to payment and applicable law. Purchasing it does not transfer ownership of FocusLatex's pre-existing or independently developed patterns, templates, grading, construction methods, manufacturing techniques, tooling or know-how.

Unless a separate written agreement provides otherwise, FocusLatex may reuse general ideas, techniques and non-protected design elements, but will not knowingly reproduce customer-owned original artwork in violation of the customer's rights. Reviews, wearing photographs and videos will not be used for marketing without separate, specific permission.

Safety-Sensitive Custom Designs

Hoods and any custom product that may restrict breathing, vision, communication, circulation, movement or emergency removal are only for adults aged 18 or over and remain subject to the Latex Care & Safety guide and Terms of Service.

No customer approval transfers product-safety responsibility entirely to the customer or requires FocusLatex to make an unsafe design. We may require adequate breathing openings, an immediate release method, structural changes or other safeguards, or may refuse the request.
